Former Republican South Carolina Rep. Trey Gowdy said Friday on Fox News that President-elect Donald Trump’s “silver lining” is that he can have a strong appeal in his New York conviction, following his updated sentencing schedule set by Judge Juan Merchan.
The former president’s legal team asked that the case be moved to a federal court, instead of state court where it currently resides, claiming that the move is warranted because the prosecution allegedly violated Trump’s constitutional rights.
A federal judge ruled in July that Smith’s appointment as special counsel violated the U.S. Constitution.
“The president has the authority to defend the country against foreign enemies — armed conflict and so forth. He has the authority to direct the justice system against criminals at home. He doesn’t have the authority to go and assassinate people.”
“I know lawyers who have been asked to defend Donald Trump on First Amendment grounds,” Dershowitz said on the Wednesday edition of the “Just the News, No Noise” TV show. “They would normally take the case, but they say, ‘we can’t afford it for our family because they’re coming after our bar license.’ It’s exactly what happened during McCarthyism.”
The president should step aside rather than find out how the deep state would save his candidacy.
