Even as President-elect Donald Trump promised on Sunday to act “very quickly” on pardons for many of the protesters involved in the events of Jan. 6, the Biden administration’s Justice Department is continuing to arrest and try people for actions that occurred almost four years ago while opposing motions to delay trials because of the need for “the prompt and efficient administration of justice.”
The renewed promise was made in the wake of Biden’s controversial decision to pardon his son.
Friday’s Supreme Court decision holding that the most severe law cited in January 6 prosecutions does not apply to riots or protests effectively means that the oft-repeated accusations of “insurrection” have been downgraded to mere trespassing.
The Supreme Court decided a case Friday that will affect the prosecutions of around 350 individuals charged in connection with the events at the Capitol on Jan. 6, 2021. And the decision could also well affect two of the four charges brought by special counsel Jack Smith that are pending against former President Donald Trump in federal court in Washington, D.C.
The order, signed by U.S. District Judge Trevor McFadden on March 26, will grant the release of Kevin Seefried, a defendant convicted for his role in the Jan. 6, 2021, Capitol breach, pending the appeal of his conviction.
